General Terms and Conditions
1. Scope of application
The scope of application covers all orders and services that are concluded via our online shop by a natural person or legal entity. In the following, natural persons and legal entities are referred to as Customers.
In relation to Customers, these GTC also apply in future business relations, without KeyFinder AG being required to refer to them again. If the Customer uses contrary or supplementing terms and conditions, it is hereby objected to their applicability; they will only become a part of the contract if KeyFinder AG has expressly agreed to them.
2. Parties to the contract, conclusion of the contract
The purchase agreement is concluded between the Customer and KeyFinder AG.
By placing the products to the online shop, we make a binding offer to conclude the contract for these products. You can initially put our products into the shopping cart without commitment and correct your input at any time before submitting your binding order. The contract will be concluded by your acceptance of the offer for the products contained in the shopping cart when you click the order button. Directly after sending the order, you will receive a confirmation by email.
On conclusion of the order, the Customer confirms his agreement with the General Terms and Conditions.
3. Contract language, storing of the contract text
The languages available for the conclusion of the contract are German, French, Italian and English.
4. Terms of delivery
We deliver inside of Switzerland for CHF 3.50.
Collecting the products in person is not possible.
For deliveries to foreign countries, we pass on the costs 1:1 to the Customer.
5. Payment
You generally have the following payment methods available at our shop:
Invoice
You will receive the invoice along with the products. If you select the “on invoice” payment method, the invoiced amount must be transferred within 14 days upon receipt of the invoice to the bank account specified in it.
Credit card
The delivery will be made, as soon as the amount was charged to the credit card.
PayPal
The delivery will be made, as soon as the amount was debited via PayPal.
6. Right to return
We grant a right to return ordered products.
For products not ordered, we ask the Customer to contact us as soon as possible, so that he can return the products free of charge to us.
7. Transport damages
The risk of accidental loss and accidental deterioration transfers to you, as soon as we have delivered the item to the carrier, freight forwarder or other person or entity designated for the execution of the shipment. The duty to inspect and notify of defects as stipulated under Art. 201 OR [Law of Obligations] applies among merchants. If you fail to give notice as prescribed therein, the products will be deemed approved, unless it is a defect that was not detectable in the inspection. This does not apply if we have fraudulently concealed a defect.
7. Shipment of lost keys
The lost keys will be returned to the Customer by A+ post for the cost price of CHF 14.00. On explicit request by the Customer, the keys can be returned by registered letter.
8. Extension
The Customer will receive a letter for extension automatically after a contract term of 5 years. If no response is sent to this letter, a further reminder will follow.
8. Data privacy
KeyFinder AG observes all guidelines of the Swiss data protection laws to the full extent. Without exception, all Customer data is used only internally and is not disseminated to third parties.
9. Place of jurisdiction
The legal relationship between the Customer and KeyFinder AG is governed exclusively by Swiss law. The place of jurisdiction is Wollerau, SZ.
